TESTIMONIAL AFFIDAVIT & RELEASE (CONSUMER)

For good and valuable consideration, receipt of which is hereby acknowledged, I irrevocably grant to Nutramax Laboratories, Inc. ("Nutramax") and its licensees and assigns the perpetual, worldwide and absolute right to display, reproduce, publish,  perform, exhibit, distribute, transmit, post, broadcast, sublicense, sell, transfer or otherwise make any commercial or non commercial use of my image (whether in still life or in video, or three dimensional representation), likeness, persona, biographical information and my statements and opinions about Nutramax and its products (including, without limitation, the testimonial provided by me) (collectively, "Information, Persona and Statements") in whole, in part or with or in connection with other materials for advertising, publicity and any other legal purpose, in perpetuity, throughout the world, in any and all media, whether now known or hereafter developed, including, without limitation, on the internet, without additional consideration, review or approval and to modify and create derivative works based on my Information, Persona and Statements.

I hereby affirm that the Information, Persona and Statements are a true and accurate reflection of my opinions about Nutramax and its product(s) ("Nutramax Products") and I hereby affirm that I am a bona-fide user of the Nutramax Products.  To the extent my Information, Persona and Statements contain information about a third party's experience with Nutramax Products, I hereby affirm that such information is true and accurate and can provide (upon Nutramax's request) documentation from the third party attesting to the same.  I hereby release and agree to indemnify Nutramax and its licenses and assigns from any and all liability arising out of their use of the Information, Persona and Statements.  I further agree and covenant not to sue or bring any other proceeding against any Nutramax or any licensee or assign based upon or relating to Nutramax's or any licensee's or assign's use of my Information, Persona and Statements, including, without limitation, any claim for violation of my right of publicity, privacy, moral right, defamation or interference with contract.

PETS: To the extent I have provided a photograph or video of my pet(s) to Nutramax, I hereby represent and warrant that I am the owner of the photograph (including the copyright in the photograph) and the pet(s) depicted in the photograph or video.  I agree and consent to the use of such photograph or video in accordance with this Affidavit and Release [including, without limitation, the name(s) of my pet(s)] , including, without limitation, for purposes of advertising the Nutramax Products.  I agree that if Nutramax actually uses my pet(s) in advertising, I will not allow my pet(s) or the name(s) of my pet(s) to be used as a model or character or otherwise by any third party in connection with any other party’s advertising or promotion of products or services that are similar to or in the same field as Nutramax (or any successor in interest to Nutramax).

MY CHILD(REN): To the extent I have provided a photograph or video of my minor child(ren) to Nutramax, I hereby represent and warrant that I am the owner of the photograph (including the copyright in the photograph) and I am the parent or legal guardian of that/those child(ren).  To the extent that I have provided a quote or statement from that/those child(ren), I represent and warrant that is it their quote and/or statement.  I agree and consent to the use of such photograph, video, quote or statement in accordance with this Affidavit and Release, including, without limitation, for purposes of advertising the Nutramax Products.

I agree that I will not post any information about this Testimonial Affidavit & Release, the Nutramax Products or Nutramax on the internet or via any other medium, including, without limitation, on any social networking sites or features, without the prior written approval of Nutramax and then only in accordance with any Nutramax provided guidelines.

I am at least the age of majority in my state of residence and have the full right to enter into this affidavit and release and grant the rights set forth in this affidavit and release.

I understand that nothing in this affidavit and release requires Nutramax to use the Information, Persona and Statements in any manner or to attribute the Information, Persona and Statements to me.  I hereby waive any right that I may have to inspect and/or approve the use of the Information, Persona and Statements; however, I understand that Nutramax may request my review of its use of my Information, Persona and Statements and I will promptly cooperate with Nutramax to comply with such a request.

I represent that I provided my Information, Persona and Statements voluntarily, on my own and without any promises from Nutramax.  I agree to immediately notify Nutramax in writing if there is any change in my Information, Persona and Statements or if I or any other person referenced as user of the Nutramax Products in my Information, Persona and Statements cease to be a bona fide user of the Nutramax Products.
