Nutramax Laboratories, Inc. successfully enforces its trademarks

Nutramax Laboratories, Inc. became aware of a trademark application filed for Nutrimax in the United States in the same class of goods as its registered trademark.  An opposition was filed at the U.S. Patent & Trademark Office (“USPTO”) as well as a complaint filed in the courts citing trademark infringement.

On July 17, 2007, the United States District Court for the District of Maryland entered an Order granting Nutramax Laboratories, Inc. motion for Judgment by Default permanently enjoining the defendant, Nutrimax USA, Incorporated, and its officers, agents, employees and attorneys from suggesting, stating, representing, implying or deceiving the public and from competing unfairly by advertising, promoting or offering to sell or license any dietary food supplement product in any manner that contains the word “Nutrimax” or any other word or mark that is confusingly similar.  The court’s decision also requires the defendants to destroy all documents that contain the word “Nutrimax” and modify all internet webpages and electronically stored information.

Nutramax Laboratories, Inc. is the owner of 30 registered trademarks in the United States and 15 trademark applications awaiting registration, as well as many international trademark registrations for the same marks.  The company vigorously enforces its trademarks by closely watching applications being filed at the United States Patent and Trademark Office and internationally.  If the company feels there could be potential infringement or confusion issues it follows through with filing oppositions as well as filing complaints with the courts in order to protect and maintain the value of its trademarks.
