Nutramax Laboratories, Inc. Defeats Class Action Lawsuit in California Court

November 1, 2012 – Edgewood, MD – Nutramax Laboratories, Inc. announces that they have defeated a Class Action lawsuit in a California Court. In April of this year a California law firm filed a Class Action lawsuit against Nutramax Laboratories Inc.’s Cosamin®DS Joint Health Supplement.
Cosamin®DS has set the standard of excellence for glucosamine/chondroitin sulfate products. Cosamin®DS was the first glucosamine/chondroitin sulfate product on the market worldwide nearly twenty years ago, and it has been proven effective in placebo controlled, published, U.S. clinical studies to reduce joint pain.
Yet the lawsuit claimed that glucosamine and chondroitin sulfate, the two main ingredients in Cosamin®DS, do not relieve joint pain as advertised. The California-based law firm brought a class action contending that Cosamin®DS advertising related to joint pain and cartilage protection were false.
The federal court, however, agreed with Nutramax Laboratories’ arguments that class certification was not appropriate. Apart from the wealth of scientifically sound, clinical studies that established Cosamin®DS has beneficial effects, the court agreed that the claims and allegations failed. The attorneys decided not to pursue an appeal of the court’s decision to deny class certification and instead dismissed the case. This Class Action victory is the first of its kind among many class actions filed against glucosamine/chondroitin sulfate products in federal and state courts across the country.

Going forward, Nutramax Laboratories will reconsider its position to sell our new human products in states such as California, which support these types of anti-business/anti-consumer laws.”
